These general conditions of sale, or “CGV”, apply between:

registered in the Paris Trade and Companies Register under number 853 928 927, intra-community VAT FR12 853 928 927.

 

And the “Customer”, designating any natural person, having the status of consumer, making a purchase on the site www.fleuron.paris

 

Acceptance of the General Terms and Conditions

Validation of the order by the Customer constitutes unreserved acceptance of these General Conditions of Sale.

FLEURON PARIS reserves the right to adapt or modify these General Terms and Conditions at any time. The version of the General Terms and Conditions applicable to any order being that appearing online on the website www.fleuron.paris at the time of the order.

 

Product description

We strive to describe and present the products on our site www.fleuron.paris with the greatest possible accuracy, each photo representing our products has been chosen carefully in order to be the most representative.

However, the photographs are presented for informational purposes only and have no contractual value. Colors vary depending on the light, the use of natural materials means that two products will always be very slightly different, and handwork also gives a unique character to a product.

 

Price applied

Within the EEC, all prices of our products are indicated in Euros (€), all taxes included (TTC), excluding delivery costs.

Outside the EEC, the prices indicated are excluding taxes (HT), excluding delivery costs. Customs fees and other taxes must be paid by the Customer directly to the carrier.

Order processing fees are included in the prices shown. Prices are guaranteed subject to typographical or printing errors.

Fleuron Paris, however, reserves the right to modify the price of the products at any time, the applicable price being the price in effect at the time of the order.

 

Product availability

The products are offered for sale while stocks last. However, if a product was unavailable after the order and payment, FLEURON PARIS undertakes to cancel the order and reimburse the Customer.

 

Order process

The order is placed by the completion of the following steps by the Customer:

Selection of a product, its color and the desired quantity, then add to the basket;

Selection of the delivery method, after checking that the product(s) present in the basket correspond(s) to your selection.

Selection of the payment method, and actual payment of the order.

 

At the end of the order placement, FLEURON PARIS sends the customer by email an order confirmation, which results in the conclusion of a contract between FLEURON PARIS and the Customer and the triggering of the preparation and delivery of the order.

 

FLEURON PARIS reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a current or previous order, or which does not comply with these General Terms and Conditions.

 

Means of payment

Payment for the order is due in full on the date of validation of the basket by the Customer.

Accepted payment methods are by credit card (Visa, MasterCard), by Paypal and Applepay,  via the secure Stripe system.

You make your purchases in complete security, all information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol.

Payment card numbers are not stored on our site but on the secure site of a banking establishment.

 

Shipping processing

Order processing is effective within 24 working hours following validation of the order, Monday to Friday, excluding public holidays.

In the event of a force majeure event, FLEURON PARIS cannot be held responsible in the event of delays or inability to perform its contractual obligations, according to current case law.

FLEURON PARIS undertakes to inform the Customer by email in the event of a delay in processing the shipment.

 

Delivery

The packages of prepared orders are delivered to the carrier chosen by the customer, La Poste or DHL.

Delivery times are communicated by the carriers for information purposes only. Exceeding these deadlines cannot under any circumstances be held against FLEURON PARIS, nor constitute a cause for termination of the contract, nor give right to any compensation for damages.

FLEURON PARIS is responsible for the delivery of the goods, including transport costs to the destination agreed with the Customer (incoterm DAP). Costs for carrying out import formalities are expressly excluded and are borne by the Customer. Thus, all taxes related to importation into the destination country are paid by the Customer.

  • Standard Shipping:
    Free delivery by Colissimo for orders above €295, or €9 for orders below this amount.
    Home delivery with signature within 2 to 3 business days.
  • Express Shipping:
    Delivery by DHL, €9 for any order.
    Home delivery with signature within 1 to 3 business days.

For orders equal to or above the amounts mentioned above, shipping is free.

    For orders below the defined thresholds, a flat fee of €25 applies.

    2 to 3 business days for standard shipping, 1 to 3 business days for express shipping.
  • Europe (European Union), Switzerland, United Kingdom:
    2 to 3 business days for all orders.
  • United States, Canada:
    3 to 7 business days.
  • Asia (China, Hong Kong, Taiwan, Japan, South Korea, Singapore, Philippines, Malaysia):

Customs Fees and Taxes

For any order shipped outside of the European Union, customs fees and import taxes may apply and are the responsibility of the customer. These fees are payable upon receipt of the package.
If delivery is refused or the package is not picked up by the Customer, return shipping fees will be deducted from the product refund up to €25.

Order compliance

It is the Customer's responsibility to ensure, upon receipt of the package, the conformity of the items.

Any anomaly concerning damaged exterior packaging, damaged products, missing products must be reported to the carrier.

Any product that does not conform to the order must be notified within 24 hours by registered letter or by email to customer service at the following address: hello@fleuron.paris

FLEURON PARIS undertakes to cover the return costs for any product deemed non-compliant according to the criteria of model, color, or defective product.

Once this limitation period has expired, FLEURON PARIS disclaims all liability.

 

Guarantees

All products offered on the Site are subject to the legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code) and to the guarantee of hidden defects (articles 1641 et seq. of the Civil Code), allowing the Customer to return defective products delivered.

Return costs are covered by FLEURON PARIS, within the limit of one return shipment of products per order.

The Customer can decide between an exchange of the same product, consistent with their order, an equivalent product at the same price, or a refund.

Returns and withdrawal


In accordance with Article L 121-20 of the French Consumer Code, customers have a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to provide any reason or pay any penalties.

The date on the delivery receipt provided by the carrier marks the starting point of this withdrawal period.

Return shipping costs are the responsibility of the customer. If the customer wishes to receive a prepaid return label through our partner DHL, a fee of €25 will be deducted from the refund. To request a return label, the customer can contact us by email at hello@fleuron.paris, mentioning their order number and contact information.

In the event of a return, the customer must retain proof of the return shipment, duly stamped by the post office or carrier. In case of a shipping dispute, this proof will be required to initiate an investigation with the carrier.

Returned products must be unworn, unused, with their original tags, and sent back in their original packaging along with any accompanying documents.

Damaged products, incomplete items, or those showing signs of use will not be accepted for return, exchange, or refund.

Customs Fees Refund Policy

Customs fees paid by the customer upon delivery are not refundable in case of a return. The refund will only cover the price of the returned products, provided they meet the conditions stated above.

Processing Time

Return processing time: 2 to 3 business days after receiving the products.
Refund processing time: 5 to 7 business days after the return has been approved.

Personal data

The personal data collected from the Customer on the Site are intended for the exclusive use of FLEURON PARIS and its partners,  responsible for the proper execution, processing and delivery of the order.

This data is necessary to produce the invoice intended for the customer.

Personal data is also collected through cookies, the customer can decide to refuse by deactivating cookies.

In accordance with the provisions of the Data Protection Act of January 6, 1978, the Customer has a total right of access, modification, rectification and deletion of personal data concerning him.

The Customer is also informed that, as part of the fight against Internet fraud, verification will be carried out by banking establishments and credit card organizations via the PayPal system. PayPal SARL & Cie, SCA is responsible for the storage and automated processing of information for all orders, including bank details, in a secure environment.

Concerning the processing operations carried out by PayPal, the Customer may exercise his right of access, rectification, opposition (for legitimate reasons) and deletion of his personal data, by sending a letter accompanied by a proof of identity to: PayPal SARL & Cie, SCA (“PayPal Europe”) 22-24 Boulevard Royal L-2449 LUXEMBOURG (+352 – 27 302 143).

 

Limit of liability

FLEURON PARIS declines all responsibility in the event of disruptions to the Site, computer errors or errors on the Site, sending of emails to an incorrect address or any other malfunction or interruption linked to the Internet.

FLEURON PARIS also declines all liability in the event of direct, indirect or consequential loss or damage suffered by any User in connection with our Site or its use, an inability to use it, or the consequences of the use of our Site, websites linked to it and any information published on our Site, including but not limited to any:

loss of activities or exploitation

loss of turnover, profits, income, planned savings

loss of contracts or customers

data loss

waste of time in terms of management or administration

and any other loss or damage whatsoever, whatever the cause and whether resulting from tort (including negligence), breach of contract or any other cause, even foreseeable.

 

Applicable law – Dispute Resolution

These General Terms and Conditions are written in French and subject to French law, unless otherwise mandatory.
